Widowmakers AB organization no. 559279-8598 (“Widowmakers”) operates the website www.widowmakers.se and related pages (the “Website”). Contact details and other information about Widowmakers are shown on the Website. Via the Website you can buy goods directly from Widowmakers.

1. General

1.1 These general terms and conditions (“Terms”) apply when you as a consumer (“Customer”) place an order via the Website.

1.2 In order to place an order on the website, the customer must be at least 18 years old. Under Swedish law, the Seller does not accept credit purchases from persons under the age of 18. The Seller reserves the right to refuse or change a customer’s order in individual cases (e.g. if the customer has provided incorrect personal data and/or has payment remarks).

1.3 The Seller reserves the right to make final sales and any pictorial and typographical errors on the website, such as errors in product description, incorrect prices and price adjustments (such as changes in prices from suppliers, currency changes) or incorrect information regarding whether an item is in stock. The Seller is entitled to correct any such errors and to change or update the information at any time. All pictorial information on the website should be considered as illustrations only. Such illustrations cannot be guaranteed to reproduce the number of goods the customer receives or the exact appearance, functions or origin of the goods. Widowmakers is not responsible for information on the website that comes from partners or a third party.

1.4 The Website is owned by Widowmakers. The content of the Website is owned by Widowmakers or its Partners or its licensors. The information is protected by, among other things, intellectual property and market laws. This means that trademarks, company names, product names, images and graphics, design, layout and information about goods, services and other content may not be copied or used without written permission from Widowmakers.

2. Contract and Order

2.1 In order to make a purchase via the Website, the Customer must accept the Terms and Conditions. By accepting the Terms and Conditions, the Customer undertakes to comply with the Terms and Conditions in their entirety, and agrees that he has read the information on personal data and consented to the use of personal data and cookies in accordance with Widowmaker’s Privacy Policy.

3.1 Widowmakers recommends that the Customer creates a user account before the Customer shops on the Website. When the Customer registers his user account and/or places an order, the Customer will be asked to provide certain personal data. 3.2 The Customer undertakes to ensure that no one other than the Customer can use the Customer’s login details. The Customer may not disclose the username and password to any unauthorized person and must ensure that the document containing the username and password is stored in such a way that unauthorized persons cannot access the information. The Customer must immediately notify Widowmakers if it is suspected that an unauthorized person has gained access to the Customer’s password. The Customer is responsible for all purchases made with his/her login information if such notification has not been made.

3.3 If Widowmakers suspects that the Customer abuses his user account or his login details or otherwise violates the Terms and Conditions, Widowmakers has the right to suspend the Customer. Widowmakers also has the right to assign new login details to the Customer.

4. Prices, charges and payment

4.1 When ordering via the Website, the prices stated on the Website apply. Prices are stated in Swedish kronor and include VAT. Prices do not include payment and shipping fees, which are stated separately.

4.2 The Customer can pay in the manner specified on the Website. The Seller is entitled to charge the Customer already in connection with the order, unless the Customer has chosen invoice payment or another similar payment method. In the case of invoice payment or partial payment, a credit check may be made. You will in such cases be informed about this. Widowmakers reserves the right to not always offer all payment methods and to change the payment method if the one chosen by the Customer for some reason does not work at the time of purchase or the Customer is not approved for the chosen payment method.

5 Promotions and offers

The Seller may from time to time offer promotions on the Site which may have more favorable terms than those set out in these Terms. These more favorable terms will apply for the duration of the promotion and for the specific goods indicated by the Seller in connection with the promotion. The Seller reserves the right to withdraw such promotions at any time. In the event of termination or withdrawal of a promotion, these Terms and Conditions will apply without modification. Offers on specific goods on the Website are valid for a limited time and while stocks last.

6 Delivery and transportation

6.1 Goods in stock are normally delivered within the number of working days indicated on the Website.

6.2 The expected delivery time of the goods is shown in the order confirmation, at the checkout and/or on the relevant goods page on the Website. If the delivery is delayed, the Seller will notify you and continue to monitor the order. Unless otherwise agreed, if a delivery takes more than 30 working days and this is not due to you as a Customer, you have the right to cancel the purchase.

6.3 If parcels are to be redeemed, the Customer must do so within the time specified in the notification. Parcels must normally be collected in person with valid identification and a parcel ID. The Customer always receives a notification showing where and when parcels are to be collected. Notification can be made by e-mail, regular mail and, if the Customer has provided a mobile phone number, also by phone call or SMS.

6.4 Widowmakers reserves the right to charge you for packages that are not picked up or not received for all costs incurred in connection with such return, currently 150 kr. This fee is charged separately by invoice.

7 Right of withdrawal

7.1 When purchasing goods on the Website, a 14-day right of withdrawal always applies in accordance with current consumer protection legislation. This means that the Customer has the right to cancel their purchase by notifying this within 14 days of the Customer or the Customer’s representative receiving the ordered goods (the withdrawal period).

7.2 The right of withdrawal does not apply to the following types of goods: (a) goods with broken seals; and (b) digital content delivered other than on a physical medium.

7.3 If a product has been sealed, the Customer may not break the seal if he wishes to exercise his right of withdrawal. The right of withdrawal therefore ceases when the Customer breaks the seal.

7.4 If the Customer wants to cancel a purchase made via the Website, the Customer must send a clear and concise message to Widowmakers before the cancellation period expires. The Customer must state his name, address and other relevant information, such as order number, invoice number and name of the product in the message.

7.5 When exercising the right of withdrawal, the Customer pays the return freight, unless otherwise stated. The Customer’s responsibility ends when Widowmakers has received the return. The Customer must save a receipt for the return. The goods must be returned within 14 days from the date the notice of withdrawal was submitted to Widowmakers. The goods must be sent well packaged, in good condition.

7.6 When the Customer cancels his purchase, the amount paid by the Customer for the goods is returned to the Customer, including delivery costs.

7.7 The Seller shall refund the amount as soon as possible, but no later than 14 days from the date of receipt of the Customer’s notice of withdrawal. However, the Seller may withhold the refund until the Seller has received the goods or the Customer has provided evidence that the goods have been returned, e.g. a delivery receipt. The reimbursement will be made to the Customer via the payment option chosen by the Customer, unless otherwise agreed or there are obstacles to such reimbursement.

8 Links

Widowmakers may link from the Site to other sites that are beyond Widowmakers’ control, and sites beyond Widowmakers’ control may link to the Site. Although Widowmakers tries to ensure that Widowmakers only links to websites that share Widowmakers’ personal data and security regulations according to the Privacy Policy, Widowmakers is not responsible for the protection or confidentiality of information or personal data that the Customer provides on other websites. The Customer should exercise caution and read the personal data regulations of the website in question.

9 Force Majeure

The Seller is not liable for delays caused by circumstances beyond the Seller’s control, such as general labor disputes, war, fire, lightning, terrorist attacks, changes in government regulations, technical problems, faults in electricity/telecommunication/data connections or other communications, and faults or delays in subcontracted services due to the circumstances listed here. These circumstances shall constitute grounds for exemption from damages and other penalties. Should such a situation arise, the Seller shall inform the Customer at the beginning and end of the period of the situation in question. If the circumstance has lasted longer than two months, both the Customer and the Seller have the right to cancel the purchase with immediate effect.

10 Changes to the Conditions

The Seller reserves the right to make changes to these Terms and Conditions at any time. All changes to these Terms and Conditions will be published on the Website. Changes apply from the time the Customer has accepted the Terms (in connection with a new purchase or when visiting the Website), or 30 days after the Seller has informed the Customer of the changes. However, the Seller recommends that the Customer regularly updates the Website in order to be aware of any changes to the Terms and Conditions.

11 Invalidity

If any provision of these Terms and Conditions is found to be invalid or unenforceable by a competent court, authority or arbitration board, that provision and all other provisions shall be valid and enforceable to the extent permitted by applicable law. The provisions declared invalid or unenforceable will be replaced by relevant legal guidance and advice.

12 Applicable law and dispute

12.1 If a dispute cannot be resolved in agreement with the Seller’s customer service, you as a customer can turn to ARN (Allmänna reklamationsnämnden) which you can find more information about at www.arn.se. You can also submit a complaint directly online via the European Commission’s platform for mediation in disputes, which you can find via the following link https://ec.europa.eu/consumers/odr. If you submit a complaint via this platform, your case is automatically forwarded to the appropriate national dispute resolution body. This dispute resolution body will then contact the seller and try to resolve the dispute without involving a court.

12.2 Disputes concerning the interpretation or application of these Terms and Conditions shall be interpreted in accordance with Swedish law and shall be settled by the National Board for Consumer Disputes or ultimately by a general court.
